I was released from Dell after many years of dedicated service. This is based on my personal experience and I want to share what I have discovered over the past months, things I wish I had known when I was tossed out the door. This is not legal advice, just sharing information in hopes that it may help someone else.
The first question you should ask yourself if you are offered a package is, should I have the documents reviewed by an attorney. The answer is yes and it is important to talk to someone that is well versed in employment law due to the complexity. It is difficult to find an attorney in the Austin area that specialize in employment law and does not have a conflict due their previous relationships Dell.
Basic information, there is generally two parts to the separation package.
1. Payment in lieu of WARN Notice - this is a federal law which requires you to be paid 60 days’ compensation whether you sign the agreement or not in.
2. Consideration from Dell – the package will most likely include severance pay as well as other considerations and there is generally an assumption that all Consideration packages are equal and adequate. The truth is they may not all be the same and everyone has different circumstances therefore may be entitled to different considerations.
I would like to share the name of the attorney that I have found that specializes in this area of the law, Daniel B. Ross. Feel free to use this information or not, take it in the manner in which it is intended, to help each other, the way we did when we worked as a team at Dell.

Certainly not some well meaning ex dell employee. Wink

I've gotten a severance from Dell. I know they're not that complicated, and I'd be damned before I gave up any bit of it to some spamming lawyer to read it for me.

I was attempting to post this information in the most likely forums that an employee (ex or otherwise) might see it, so these three forums were it.

Since there was additional layoffs last week and rumors of many more in the next couple of weeks I was trying to share valuable information. Sorry I was not aware posting the same message in three different forums would be considered SPAM.

Mr. Ross did not ask me to post this information or make any recommendations on his behalf, I did so based solely on my own decision. Any time you are looking a service of any kind, most people tend to ask family, friends or colleagues for recommendations. He is one of the most ethical attorney’s I have ever met and he is not an ambulance chaser. I think comments are a little unfair. I am exactly has you described “a well meaning ex dell employee” . My package looked basic and solid but there was a huge missed opportunity, my loss. I only wanted to try and help prevent that from happening to someone else.

Again, sorry if you feel like you were spammed, that was not the intent. I have searched for a forum that has less offensive graphics in the postings and on the home page, but I did not have much of a choice. I hope this will help someone and if you don’t need it just delete it. I am done Sad

What was that opprotunity? Legal documents are written to where the average Joe just gives up and signs... so enlighten us on that opprotunity we might miss, before anyone signs anything they might regret.

Each employee has different circumstances and conditions. This may surface during a confidential discussion with the attorney. My opportunity is of a personal nature and I am not willing to share that information.

The important piece is it never hurts to have it reviewed by someone who know the law and right questions to ask.

Thanks for the thoughtful PM, Mr. Ross.
Aside from the WARN payment (which only applies in certain circumstances, not in all), Dell doesn't have to pay you anything when they lay you off, so there really isn't any point in paying a lawyer to look over anything because you're not going to get Dell to change anything, and anyone other than a lawyer trying to prey on vulnerable people would know that, so no, I will not let it go, and your fake emotional manipulation will not work on me. Cool

I respectfully disagree. As a manager, I saw plenty of severance packages renegotiated by the former employee and made better by Dell - Dell will generally offer more, rather than deal with the expense and hassle of a lawsuit.

Look, people, I know everyone's skeptical of any commercial or professional transaction. I'm skeptical of doctors. No matter what you say the problem is, they want to pump you full of expensive drugs with worse side effects than the original problem.

But if an employment attorney can get you a couple thousand dollars with a $50 registered letter to Dell HR (the nominal fee for that), wouldn't you be something of idiot not to look into it?

It costs nothing to call and ask what the terms of consultation are. If you don't like them, say thanks and hang up.

Bear in mind, I'm the ultimate arbiter of what is spam on this board. And I don't consider a reference to an employment attorney spam, as it is relevant to the flood of ex-Dellers who have been or are fixing to be dumped. You're invited to moderate your reactionism accordingly.

Yes, the attorney will make money, but if you'll make more, where's the harm? I knew a woman at work in the early 90s who sued our employer for gender discrimination, and got $30,000 out of it, AFTER attorney fees. So no, employment attorneys are not Dellian hosebag spammers. When you have a case, they get you more money than they cost. If you don't have a case, a reputable attorney will just tell you that and not charge much for looking at your situation, if anything.

Dell employees are bitching and moaning about their precious separation packages.

Get real. Most workers don't get separation packages when they get let go from a job. All they get is what they're due for unpaid time worked and that's it. Then they find another job. That's all Dell employees should expect as well.

The truth is the only people who do get compensated when they leave a company are the executives. And in big bucks.

And never trust a lawyer, much less one who spams to solicit clients.
