The reason I have a problem with refurbished parts:
I was recently sent a hard drive that had not been wiped completely clean. (Of course, I didn't find out about this until I had spent the hours required to actually get it up and running, which was a bit of a challenge, considering I was sent the wrong device drivers.) As such, I have the remnants of 20 gigs of data from its previous owners.
The guy on the phone at Dell pretty much begged me to send it back to them. Sorry buddy. Until I get a complete NEW system exchange, this hard drive's all mine. And I plan to have an expert tell me what the hell is actually on it. Here's hoping it's sensitive financial information... |

Er.. not to want to play devil's advocate.. but you basically just made plans for extortion, confessed to conspiring to steal one or more identities, etc. Here's hoping that this "expert" realizes he doesnt want to be an accesory to those crimes..
Not that I think you'd actually DO any of that, because then you'd be just as guilty, if not more so, as whomever didnt erase it in the first place. |

Though this thread is fairly obsolete...
Um, no it's not extortion. He did not threaten the person on the phone that he was going to abuse the data, or even recover it. And once he finds out what 'experts' charge, he won't be doing anything but repartitioning.
It's a helluva piss-weak job of 'refurbishing', not even erasing prior content. But the refurbisher guy was probably behind on his metrics that day. You know how that goes.  _________________ Rocke T Sinetist

It would only be considered extortion if the accused openly made reference to the dreaded "or else" statement.
"Give me a system exchange OR ELSE I will use this data recovered for whatever means I can".
THAT is extortion.
"I have nudie pics of you and someone who isn't your wife. Pay me $100B OR ELSE I'll leak the pics."
THAT is extortion.
"Give me a system exchange or you're not getting the hard drive back that you failed to wipe clean."
That is NOT extortion. |

It was not extortion, but it does sound like you were giving him legal advice. That is fine if you're an attorney. If you not an attorney, you could be guilty of practicing law without a license -- not that anyone would ever do anything about it. I can give this opinion for recipients in California.
There a legal aspect to these problems but that is for another posting |

Now settle down. Saying "you should sue them" is not legal advice, any more than saying "I have data on this drive" is extortion.
