So I quit DELL Ottawa two weeks ago and have yet to receive my Record Of Employment or a final pay. Two weeks? According to the law in this country and province, I'm legally entitled to these things. I plan to contact the appropriate government offices and see what kind of mess I can dump on DELL's door-step. Perhaps even contact some local media. That should upset Ottawa's PR guy.
I got my bonus and quit 5 minutes after it was deposited. And they still want my desk-key, badge and EcoPass. Hmmm... They have stuff I want, I have stuff they want. Let's trade.
It's amazing how when the smoke cleared, and the magic was gone, that DELL became just another crappy job.

Anyone else in Ottawa having a similar issue?

Well everyone I know who quit, was fired or laid off from the Ottawa site had this issue sadly. One guy took a month to get his final pay and the ROE took weeks.

All you can do is report them to the Employment Standards People. Also fill in your application for EI and on the online form state that Dell have not provided you with your ROE in a timely manner. HRDC are supposed to chase them directly.

Yeah....good luck with that...
I never had any problem with receivng all of my last pays but....
I was walked Oct 15th and I received my ROE Jan 7th....
...and that was after a dozen phone calls to HR....and then they sent by courier just before all leaving for New Years vacation....so wait all day for it to show...nothing......go to the website with tracking number....doesn't exist....more emails to Dell HR.....the next week I get an email stating "sorry" we gave the wrong info and tracking numer.....so not only did Dell conspire to lose my ROE, but they couldn't even give me the right tracking number and the person who claimed to have shipped it coudn't even tell me the correct courier company...what a bunch of fuk-up's.....
Finally based on the new tracking number I call every courier company in the city to find out if they are the one who have my ROE....finally I find them...the same day the package is to be sent back to Dell....rush down and then have to fight with courier company because Dell messed up my info and they are hesitant to release it to me....
I was almost disqualified by EI and they knew about Dell, I filled the missing ROE forms in.....nothing mattered...too big a machine....oh yeah...and if anyone calls them seeking verification that you were employed by them....they deny that you worked there....

...and when I finally get the EI claim finished by going down to the EI office and submitting it in person.....a guy stamps it and dumps it on a pile....a week later EI still claims they never received my ROE and time had expired for the claim......
Ah-ha....but I was smart enough to get a time stamped photo-copy of the ROE from EI when I submitted it.....
Needless to say...it took a bit of arguing with many governemet drones...but finally the agreed to accept the ROE as of the stamped date...
Three days later they tell me that I have to file a new claim as the first one is invalid because my Dell blood money was a"salary continuation" not "severance pay" .....sigh...but I start all over and eventually I make it to the top of the firey mountain and finally drop Golum and the ring in.....sorry I got confused there...thought I was on an epic quest...
Dell sucks most, with the government a close second, and DHL 3rd....

I think back on the dude who returned to work and threw all of his Dell shirts at the building......I wish I had done the same....except make the shirts explosive....

It is an interesting picture though....Micheal Dell dancing wildly on the lip of Mount Doom, his hand rasied high with the last customer's files who hasn't yet been so screwed by Dell they will never buy again, clutched sweatly in his hand as he joyfully exclaims...."at last, at last, my precious, my precious, my preciousssssssssssssssss.....as he slips off the edge and drops to be claimed by the molten evil from whence he came...... According to a helpful fellow at Service Canada, an employer MUST provide a Record Of Employment within 5 calendar days.
I've sent emails to several HR people and left phone messages. Anyone have MJ's email? I'll email him... shit rolls down-hill, after-all.

Ummm...yes...that's correct...they are required by law to do so...
If they don't...you can fill out a form....from that point please refer back to the middle of my story in the previous post....lol
Look...Dell knows a few tricks when it comes to government and laying people off...real solid experience...you digg??

Yeah... finally reached HR. Apparently I don't get a final pay because I took all my vacation. Whatever. I'm sure if I hadn't they would have some other pre-scripted excuse handy. As far as my ROE, it's "apparently" on the way.
I still have my badge, EcoPass and desk-key. I'll get around to sending those back eventually.
Sure, I'm not working, kinda broke... but I'm sleeping better at night. Plus, two of my team-mates quit shortly after I did.
The place is a sweat-shop. I won't miss it.

...I don't think he ever said he was getting EI....just that he hadn't got his ROE and was asking a Services Canada rep about it.... Idea

I'm not expecting to get EI. My wife gets ODSP and this process is part of the requirements to have her deposit amount adjusted, to compensate for the change in income.

Mind you, stranger things have happened. I quit my last job and got it. It depends on who looks after the case and how they fill out their forms on their end. I just need proof that I applied and was rejected.
Considering that DELL is unstable and my wife's condition requires me home at reasonable hours, it may tip the odds in my favor. I doubt it, though.

Quick update... I contacted the Ontario Labour Board regarding DELL not giving me a final pay (they say I took my three weeks vacation already, so they didn't owe me anything... including my last days worked) and apparently it's really sketchy. So, at their urging, I filed a complaint. I don't expect anything of it. I reckon it'll take 6 months to a year and DELL will be out of Canada by then. Then, good luck on trying to get jack. But, hey... ya never know, right? A year from now, if someone hands me cash... I'll go celebrate... or get drunk off my ass. Whatever.

It is my understanding that quitting a job as a call centre phone agent does not necessarily disqualify you from EI. The stress involved in these positions is known to gov't. and the medical establishment. When you apply for EI, claim stress, give laboriously detailed examples of the kind of shit you put up with from customers and company alike. If you can top it off with a note from a doctor, you are a shoe-in. A co-worker at Site L was told by his doctor to quit the job or find another doctor. Another quit due to stress and was covered.

Absolutely true, I have gotten EI after quitting other jobs and I know people who quit or were fired at Dell who got EI without problem.

EI in any province is hit and miss at the very best of times. What worked for someone may not work for you. That sort of thing.

The way they act, you'd think that THEY were paying you directly out of their own pockets.

My philosophy is fairly simple - I worked, I paid into it, I'm no longer working, Gimme my &*^%^% money. Can't be that hard a concept to grasp Wink

And from what I know of Ontario employment law, if you took all your vacation before the end of the calendar year, and you quit or were fired, they can and will deduct time from your final pay in accordance with the code. Use the figures of 1.25 days/month for accruing holiday time (if they also gave 3 weeks vacation out in Ontario like they did in Edmonton).

Using those numbers, let's say you left in March. 3 weeks of holidays is 120 hours. 2 full weeks of work is 80 hours (average). You accrued less than 4 full days holiday, but we'll round up to 4 days (24 hours).

120 - 80 (+24) = 16

Technically, you'd owe them 2 days using that example. For the sake of argument, they likely wouldn't chase after you for those 2 days, they'd just write them off. But you wouldn't see any final pay either, as you saw in your case. You'd have to quit/get fired in April or May to even the scales at no money owed and no money coming in. Earlier than that, and yes you actually owe them money according to the code (if you took all 3 weeks vacation).
