figures they are in Calif.

dont they have enough problems out there.

Suing just makes products more expensive.

I would also willing to bet NOTHING will happen with this or they will stall it in court so long that we are all dead before it gets resolved.

That's exactly what Dell wants.

So the funny thing would be to show them that it won't happen.

I can't entirely agree. Frivolous lawsuits aren't justifiable but one of the targets of this is "false claims of low-cost financing". That's pretty accurate and pretty easy to prove. DFS charges exorbetant fees for the financing of Dell systems.

I just laugh on the inside and think "no f*cking way" whenever a manager says that we have to insist that people put their HelpDesk plan on a DPA. It will take most people more time to pay it off than the plan actually lasts.

Yeah, legalized loan-sharking. But what the hey, it's commonplace now. Residue from Reaganomics when car interest rates were hitting 20% and funding for mass-transit was slashed by 30%.

After 10 years at Dell I had to resign due to harassment and a hostile work envirnoment. Does anyone know of lawyers in the Austin/RR area that have won lawsuits/settlements against Dell on behalf of former employees?

I knew one person that successfully suid dell during the layoffs a few years back. She had documentation that showed she was performing very well, but was told during the layoff it was due to performance. Then management changed the story to her job being eliminated, but then proceeded to backfill the position. She ended up winning about a years pay. The key was to have good documentation and backup info. Her lawyer originally didn't want to take the case, but when she provided a clear timeline with the facts, he saw it as an open and shut case. So it can definetely be done. Best of luck!

This is a great opportunity. The more cases they get likewise against Dell, the more solid their case is going to be.

So what? Every Right thing done WILL have a minor negative side to it. I am a strong believer that one should not coward away from doing the right thing for fear of the consequences.

If you purchased your computer via Credit Card, file a claim with your Bank. Here in the US, you have such explicit liberties, so USE IT. You received a faulty unit and have exausted resources fixing it, so file the complain, when the bank refunds you the money, send the computer back. At the most, your claim may get denied, but you won't be in any worse state than you are now.

I had purchased a calling card where they promised me 280 minutes but turned out to be only 36 minutes after I used the card. The company did not respond to my emails and it was explicitly mentioned at the time of purchase that the rates are bound to change without prior notice and at anytime. Still i filed the claim and got a complete refund. Then the card company mails me and I plesently show them the Finger Smile.

Apple is recently being sued because their earbuds (just like all the others you buy) when listened to music via iPod at high volumes can cause ear-damage.

"But, you say, it's not *their* fault people listened to their products too loud, and lost some hearing. It's their own darn fault, right?

But there are still cigarette lawsuits, and none of the tobbacco companies forced anyone to smoke their products, yet they still had to pay. McDonald's and the like get sued because they serve fattening products that harmed their customers' health, even though no one shoved all those hamburgers down any of their gullets.

And hey, Apple, you made a product that *could* go so loud as to damage people's hearing, so surely, you *intended* it to be played at those volumes with your supplied earbuds. And Apple, you *could* have provided "safer" over-the-ear headphones with your products, but nooooooo, you went ahead and supplied DANGEROUS earbuds instead!"

But the major complaint is that dell provides cheap useless products to people, and stay in business by undercutting the competition - so surely if the prices are higher, even if it isn't cos the computers have good quality bits in, people will be persuaded towards better quality but more expensive competitors?

Taking the company to court drives up the relative cost, as each lawsuit requires more capitol from sales to cover court and lawyer fees. It wouldn't matter if the company buit the most expensive but best damn computer in the world; if they still screw you over on your DPA, you're going to take them to court. And the more they do, the more cost cuts have to be made.
